Trao kiến nghị cho EU về vụ xét xử blogger Điếu Cày, Tạ Phong Tần và Phan Thanh Hải





Sáng 03/10/2012 thay mặt cho những người ký tên đợt đầu, Ban điều hành Nhóm Văn Lang Praha đã trao Bản kiến nghị của một số công dân và tổ chức dân sự tại EU về bản án của Tòa án nhân dân thành phố HCM với 3 nhà báo tự do: Nguyễn Văn Hải tức blogger Điếu Cày, Tạ Phong Tần tức Bloger Công lý & Sự thậtPhan Thanh Hải tức Blogger Anh Ba Sài Gòncho văn phòng EU tại Praha.

Trong Kiến nghị, những người ký tên đã nhắc lại tình hình vi phạm nhân quyền ở VN.
Những người kiến nghị cũng nêu rõ 2 yêu cầu đối với Cao ủy phụ trách đối ngoại của Liên hiệp châu Âu, đó là:
1/ Tiếp tục vận động và yêu cầu chính phủ Việt Nam trả tự do cho những người bị giam cầm chỉ vì họ thể hiện chính kiến của mình cũng như cải thiện tình hình nhân quyền ở Việt Nam.
2/ Đưa ông Vũ Phi Long, thẩm phán phiên tòa xét xử 03 nhà báo tự do ngày 24/9/2012, vào danh sách những người không được cấp visa nhập cảnh vào các nước thành viên EU.

Trong danh sách ký tên đầu tiên của các công dân một số nước EU từ Ba Lan, Đức, Phần Lan, Pháp, có tên nhà văn Vũ Thư Hiên (Pháp), bà Helena Klimova, ông Václav Trojan (cả hai là thành viên Hiến chương 77 CH Séc), ông Robert Krzysztoń (Hội tự do ngôn luận Ba Lan).

Nhóm Văn Lang hôm nay cũng sẽ gửi thư riêng đến Ngoại trưởng Cộng hòa Séc Karel Schwarzenberg kêu gọi ông can thiệp về việc phóng thích 3 nhà báo tự do và bảo vệ những người bị đàn áp.

URGENT PROPOSAL OF EU CITIZENS
ON THE GRAVE VIOLATION OF HUMAN RIGHTS IN VIETNAM

On 24th September 2012 in a few hours' trial in Ho Chi Minh City, the Vietnamese court sentenced the blogger Dieu Cay, namely Nguyen Van Hai to 12 years' imprisonment; Ms Ta Phong Tan – the owner of the blog "The Justice and Truth" to 10 years and the blogger Anh Ba Sai Gon, namely Phan Thanh Hai to 4 years in prison for anti-government propaganda.

Mr. Nguyen Van Hai had previously been in prison for 2 years and 6 months for what the authority called tax evasion.

On 24th September Vietnamese police arrested all people who wanted to attend the trial, which was supposed to be public, and even apprehended Nguyen Van Hai's wife and his children.

This trial has been the highest level of crackdown policy in practice for many years, especially in the last 2 years.

The current Constitution of Vietnam says that its citizens have the right for freedom of speech; Vietnam has also signed

the International Conventions on Human Rights; but in fact, its people have always been refused this fundamental right.

According to the RSF (Reporters Without Borders or Reporters Sans Frontières in French), at least 19 journalists and blog writers have been in prison in Vietnam.

The police arrests and tortures citizens whenever they like. According to the Human Rights Watch, only in 2010, 15 people were tortured to death by the police. The number of people who have died due to the questioning is increasing; the latest case was the death of Mr. Nguyen Mau Thuan on 30th August 2012 at a police station in Kim Mo commune, Dong Anh district, Hanoi.

The police has denied these accusations; they either claimed that the citizen commited suicide like Mr. Nguyen Cong Nhat in Ben Cat - Binh Duong, or they only punished the culprits lightly, e.g. in the case of the policeman lieutenant - colonel Nguyen Van Ninh, who caused the death of Mr. Trinh Xuan Tung. The policeman was sentenced to only 4 years in prison, while Mr. Nguyen Van Hai has been sentenced to 12 years' imprisonment plus 5 years under probation for his 26 articles.

All the basic values that the world and the EU respect now are being trampled on every day in Vietnam under the harshness of the police and the tribunal system. The situation of human rights and the freedom of speech is now getting worse and worse, therefore action should be taken immediately.

We highly appreciate the EU's condemnation of the sentences to the journalists and its demand to release them shortly after the court finished; however we think something more should be done for them.

We, the undersigned EU organizations and citizens living in EU, propose that the High Representative of the Union for Foreign Affairs and Security Policy raise these issues at the meeting of European foreign ministers to consider:

1. Continue persuading and demanding the Vietnamese government to free people from detention for their political opinions as well as demanding the improvement in human rights in Vietnam. 

2. Add Nguyen Phi Long, born in 1956, the judge of the aforementioned trial on 24th September 2012, to the list of the names who are not entitled to getting visas to EU countries.
